KASHMIR CONFLICT

It seems that PTI’s Kashmir narrative has, unfortunately lost some of its momentum on the international stage. The human rights struggle in Kashmir remains in limbo, as over eight million people in the region are still under a constant lock-down. The government’s policy in Indian-occupied Kashmir has been slightly marred by the lack of a subsequent follow through. Meanwhile, the Indian government has revealed the hidden demons of a society which is polarized beyond repair and a government which is furthering the religious divide in the country. The nation, already fragmented over claims of atrocities taking place inside its own geographic boundaries, has to be held responsible for its actions before the international community. 

The Indian government has shown disdain for even a recognition of the basic human rights of the prole in Kashmir, with residents in the area being deprived access to the international community for any peaceful intervention. India’s constant effort to divert focus away from its imposed war on Kashmir has indicated its intent to use terror antics over diplomacy, thereby increasing its military footprint inside IoK. As a result, South Asia is now home to the world’s biggest unofficial prison. Yet this prison remains hidden from the eyes of the world, like a forgotten island. As we continue on with our lives, somewhere out there trauma reigns.Yet most of India’s intellectual elite remain silent. They themselves are victims of a war by their own government today, including the civil society, intellectuals, think tanks, artists and human rights activists. Several journalists in Kashmir have protested against the fact that they do not have access to internet, and this ban has resulted in an inability to report about the on-ground realities currently shaping IoK. As Prime Minister Imran Khan continues to urge the United Nations to take action against Indian and step in to help resolve the rapidly deteriorating situation in IoK, it still remains to be seen whether or not the international community will actually intervene. However, the growing sense of animosity in the valley is evidenced by the fact that many politicians in IoK feel ‘betrayed’ by the Modi government. Furthermore, India’s media blackout policy in IoK, driven through a selected breed of Indian media anchors, showcases a carefully crafted state narrative which wishes to manipulate global opinion. Thus, television and social media are being used as a platforms to further this far-right extremist mentality. Issues like torture, murder, rape, kidnapping, incarceration of prisoners and other violent acts have plagued the valley for years, but one fears that these brutalities may increase in the valley in light of the increased military presence. People remain prisoners in their own homes, their mosques deserted, attendance in schools low, roads blocked and bridges closed, while several prominent Kashmiri leaders remain under house-arrest. Indian military personnel stand guard outside pathways, next to hospitals and schools, spreading fear and anxiety over subjugated populations which is demanding justice from the global community. Shockingly, worldwide news agencies covering war and conflict across all corners of the world have completely failed to cover the day to day horror which continues to unfold in IoK. Dissent is suppressed by the barrel of the gun. India must end the lock-down which has been imposed upon the people of Kashmir. Its illegal occupancy must also end so that Kashmiri’s can vote freely and exercise their rights. The world must realize that resolving the Kashmir conflict could prove to be the pathway towards attaining regional stability in South Asia.

ARMY ACT

ISPR says no truth in reports of amendment to Army actThe Pakistan Army on Wednesday quelled speculation over amending the Army Act to implement the International Court of Justice (ICJ) verdict on self-confessed Indian spy Kulbhushan Jadhav. “Speculations for amendment in Pakistan Army Act to implement the International Court of Justice (ICJ) verdict regarding convicted Indian terrorist Commander Kulbhushan Jadhav are incorrect,” Major General Asif Ghafoor, the director general of the Inter-Services Public Relations (ISPR), said in a tweet.“Various legal options for review and reconsideration of the case are being considered. Final status shall be shared in due course of time,” he added. Jadhav — a serving commander of the Indian Navy associated with spy agency Research and Analysis Wing — was arrested in 2016 from Baluchistan on allegations of espionage and terrorism. In his trial at a military court, Jadhav had confessed to his involvement in terrorism, and was sentenced to death in 2017. The ICJ, after being approached by India, had ordered a stay in his execution through an interim order. In its verdict earlier this year, the international court ruled that Jadhav be allowed consular access, and asked Pakistan to ensure “effective review and reconsideration of his conviction and sentences”.  Other remedies sought by India, which included the annulment of Jadhav’s sentence, and securing his release; however, were rejected.

US AND IRAN WAR

In the aftermath of the growing tension between Iran and the USA , everyone was predicting a strong military retaliation from the US. However, no such possibility is in the air now as the president of the USA has himself shown a deeper sense of restraint. This restraint on the part of Mr. Trump is quite rare observing the change in previous policy regarding the nuclear deal with Iran plus the recent crisis of shot down of US drone by Iran. There is a changing scenario in the Middle-East region that is not quite favorable from Trump to attack Iran. All with this the cost involved in this war is enormous which no country, even the mighty USA, is ready to accept.Geopolitics in the Middle-East region has been complex with multiple fraction, ethnic groups, power centers, and international player. In this region, the economy is driven by the oil produced in the region. Countries like USA eye on this region for their energy security by importing cheap oil and for their hegemony in Asia to counter Russia and China from capturing the vacant space. There is also present a rivalry between Iran and Saudi-Arabia with whom the USA is having a close tie up. The other two big international players like Russia and China have their economic interest more in terms of connectivity and port openings. Russia’s warm water port policy and the Chinese policy to access the European market through Belt and Road Initiative are driving force for their unchanged interest in this region.In this backdrop, the attack on Iran by the US could have involved multiple players if not immediately but in the long run which the US would not be happy to accept. Iran has a very good relationship with Russia, China and India as far as energy security, connectivity projects like the North-South corridors are concerned. So, these players could have come together to diplomatically oppose the US’ s attack on Iran. Any instability in the region would affect the global oil prices which no country would want in an already restrained economic condition.From a military point of view, Iran has considerable power to sustain in a war for a longer duration with the support of proxy militia and favorable home conditions. Further, it is having the capability to block the strait of Hormuz responsible for one-third shipment of global oil. Iran too has ballistic missile capability and in case of escalation, the next targets could be the US base in Afghanistan, Iraq, Syria. If by any chance Iran would attack Israel or Saudi- Arabia considering them as the allies of the US then the matter would be the worst.The US is also not being supported by the move to attack Iran by the European Union as they still believe in the joint comprehensive agreement signed with P-5+1(Germany). This act of aggression against Iran by the US would have diplomatically isolated the US. Back home in the US, the economy is still in a fragile phase after the shock of the global economic crisis of 2008 and rising economic powers like China-US are engaged in a trade war with one another. So, the US can’t afford another war whose end result and complexities are unknown. American in territories outside the USA for useless wars. The higher expenditures in wars have affected the social indicators because of more and more budget cut.and hence attacking and killing the Iranian would be unfair was the right approach for de-escalation. If the US wants to stop Iran from making atom bombs then they should go for diplomatic pressure instead of war which is far more devastating and destabilizing not only for the two countries but also for the world as a whole. The world needs more peace instead of war and hopefully the countries, their leaders understand that.

The Pakistan Citizenship Act

Married men not with standing anything to the contrary contained in this Act, a man, who is not citizen of Pakistan and, who is married to a woman who is citizen of Pakistan, shall be entitled for registration as citizen of Pakistan, on making application in the prescribed manner to the Federal Government, by virtue of his marriage with a Pakistani woman Provided that a man, who is not citizen of Pakistan and, who has entered into a sham marriage with a Pakistani woman shall not be entitled for registration as citizen of Pakistan under this Act. under this section shall fulfil the conditions that he has resided in Pakistan throughout the period of twelve months immediately preceding the date of the application, and has, during the ten year immediately preceding the said period of twelve months, resided in Pakistan for a period amounting in the aggregate to not less than seven years  at least five years have passed since the man married Pakistani woman and the marriage has not been dissolved or vanished the woman has not relinquished her Pakistani citizenship in favour of her husband’s citizenship or citizenship of any other country he is of good character having no criminal record and, has not been convicted by a court of competent jurisdiction for any offence involving moral turpitude and, has not acted in any manner, prejudicial to the ideology of Pakistan, or the sovereignty, integrity or security of Pakistan; and he is not citizen of any State of which a citizen of Pakistan is prevented by or under any law from becoming a citizen of that State Provided that a man shall not be entitled for registration as citizen of Pakistan under this section if he possessed such immunity from suit and legal process as is accorded to an envoy of an external sovereign power accredited in Pakistan Provided further that the Federal Government may register such man as citizen of Pakistan if he has quitted his duties as envoy of external sovereign and a period of three years has passed over 

STATEMENT OF OBJECTS AND REASONS: Right to marriage is fundamental right of every adult citizen of Pakistan. Every person of adult age and of sound mind can choose to marry with a person not prohibited by the law of the land or his personal law. The Constitution of the Islamic Republic of Pakistan in its Article 25 has guaranteed the equality of citizens and equal protection without any discrimination on the basis of sex. Article 35 of the Constitution requires from the State to ensure protection of marriage, family, mother and child. Islam has given the right to Muslim men and women to marry each other within the boundaries of Shariah anywhere in the world. Different International Instruments to which Pakistan is a party require; the abolition of gender biased laws, protection of family and right to adoption of nationality. The Pakistan Citizenship Act, 1951 contains provisions repugnant to theConstitution, injunctions of Islam and against the International law and international commitments Pakistan has made under different instruments. This Act does not grant right of citizenship to those men who married Pakistani women and intend to live in Pakistan as citizens of this country. Due to this discriminatory nature of the Act, women or children having husband or father with foreign nationality cannot be protected in accordance with the spirit of Article 35 of the Constitution. Through this amendment, the right to acquire citizenship by virtue of marriage will be extended to foreign nationals who have married Pakistani women.
